San Benito police department news briefs 6-26-12

A 36 year old man arrested and charged for possession of a controlled substance and public intoxication; A 23 year old man arrested and charged for assault family violence; A 17 year old man arrested and charged for possession of marihuana in a drug free zone. 

POSSESSION OF CONTROLLED SUBTANCE (COCAINE)

TUESDAY JUNE 26, 2012

On Saturday June 23, 2012, at 11:25 pm, San Benito Police Officer made contact with 36 year old Marcos Arriaga, out of San Benito, over by the 200 Block of Corral Street. Marcos Arriaga displayed signs of intoxication, and placed under arrest for public intoxication.

Subject was transported to City Jail where upon arrival a Police Officer discovered a small clear plastic bag that contained a white powdery substance later determined to be cocaine inside the suspect’s front pant small pocket.

Contraband was seized, and Marcos Arriaga was booked on Charges of possession of controlled substance penalty group 1 (cocaine), and public intoxication.

Municipal Judge Adolfo Cordova Subject Mr. Arriaga arraigned him and set bond at $5,000.

ASSAULT CLASS A FAMILY VIOLENCE

TUESDAY JUNE 26, 2012

On Saturday June 23, 2012, at 6:54 PM a 21 year old female arrived at the Police Station crying, and advised the Police Officers that she had just been assaulted by her boyfriend.

She identified as 23 year old Gilberto Martinez out of San Benito.

According to the victim she was driving while her boyfriend was riding in the back seat with their daughters when they both began to argue, and at one point the subject began to punch her in the face causing redness and swelling to her right side of her face as well an injury to her mouth.

According to the victim, she then stopped by the intersection of Business 77 and North Oscar Williams road, and told Gilberto Martinez to get out.

The victim stated that when her boyfriend got out she immediately drove to the Police station, while the boyfriend ran south on Williams road.

Several Police units were then dispatched to look for the boyfriend who was found hiding in a Laundromat by the intersection of Gild Drive and Williams Road.

Gilberto Martinez was then placed under arrest and transported to the police station where he was booked on charges of Assault family violence class A misdemeanor. Municipal Judge Adolfo Cordova arraigned set bond at $2,500.

Female victim refused medical attention.

POSSESSION OF MARIJUANA IN A DRUG FREE ZONE

TUESDAY JUNE 26, 2012

On Saturday June 23, 2012, at 5:28 PM, A San Benito Police K-9 Officer observed a 2002 Maroon Chevrolet Suburban traveling west on Stenger Street displaying an expired registration sticker.

The K-9 Officer then attempted to conduct a traffic stop on said vehicle, but the vehicle still traveled a few blocks before stopping by the intersection of Biddle and Commerce streets.

The driver was identified as 17 year old Jesus Muniz out of San Benito, who when asked why didn’t he pull over immediately stated that he was calling his mother, and telling her that he was being pulled over.

Jesus Muniz was acting nervously, and the K-9 Officer then asked the driver to step out of the vehicle.

Once outside the Officer conducted a pat down on the driver finding a clear plastic bag that contained approximately 0.25 ounces of marijuana inside the driver’s pants pockets. Jesus Muniz was then placed under arrest, and transported to City Jail where he was booked on possession of marijuana in a drug free zone due to being less than a 1000 feet of Frank Roberts Elementary.

Municipal Judge Adolfo Cordova arraigned him and issued a $7,500 personal recognizance bond.
